Safeguarding information capital and resources is one of the most critical challenges facing U.S. companies, with profound implications for the economy and national security. From large global multinationals to small businesses, cyber attackers are systematically targeting companies of all sizes and industries, costing an estimated $250 million to U.S. businesses each year. The spectrum of cyber attackers – state-sponsored hackers, hacktivists, and criminal enterprises  - are targeting and stealing innovative intellectual property, consumer information, health data, market intelligence, and more, resulting in what has been described as the greatest transfer of wealth in history, and the most pervasive threat to the economy and security of the nation.  In the aftermath of a breach, companies face an overwhelming set of challenges, including an onslaught of litigation and potential government investigations. Now more than ever, privacy and security counsel, professionals and executives must work together to assemble cross-departmental response and planning teams for preventing, detecting and preparing for data breaches.

Strategy discussions included:

  • Anticipating a new standard of care with the final NIST framework and measuring the effect of non-compliance in the courts
  • Implementing a risk-based approach to work with stakeholders and gain company buy-in
  • Collaborating with IT and translating technical security policies into legal strategies
  • Uncovering enforcement priorities and anticipation of continued civil and criminal enforcement
  • Formulating readily implementable data breach response playbooks that account for system integrations, numerous privacy notification laws, global operations and preserve privilege
  • Navigating the complexities of collaborating with state and federal governments
  • Understanding the scope of insurance coverage and how claims are treated
  • Devising innovative and lawful active defense strategies
  • Mitigating liability in the aftermath of a breach and telling the company story
  • Examining product liability claims and mandatory restitution stemming from breach litigation
  • Uncovering and preparing for new methods of attack on the horizon
  • Ensuring ethical obligations and reviewing new ethics opinions pertaining to cybersecurity
